Legal Question in Family Law in Texas

I have a 9 month old son and i just found out he's not my husbands child i am now wanting to leave my husband and the bilogical father wants to my son in his life, if I leave my husband does he have the right to fight for custody of my son even though he's not his bilogical father?

No, not if the biological father steps up and intervenes in the divorce, and asserts his fatherhood.
