Legal Question in Family Law in Texas

7 siblings own this house. If the rental income is to be divided between the 7 of us, and one sibling has passed away, does the widow receive 100% of the rental money or 50% to her and 50% to the kids. Brother left no will.

The answer depends on whether or not the deceased sibling's interest in the house was community property and whether any of the deceased sibling's children were not the children of the widow. I can think of at least three different answers depending on what those facts were.

I would strongly suggest that you consult with a qualified estate planning attorney. Even if you can work this out amongst yourselves, you will have a similar problem when it comes time to sell the house. Again, depending on the facts, that could open up a fourth scenario.
