Legal Question in Family Law in Texas

I have a 14 year old child. He wants to live with me, but his dad is making him wait until court. We know the judge will let him live with me, but the dad wants to go to court anyways. Does he HAVE to stay with his dad until court?

We need more information.

I assume that the child now lives with Dad.

Have you and the Dad ever been married? Are you now divorced? What kind of order is in place (if any)? What does the order say?
