Legal Question in Family Law in Texas

Can I take my 3 year old daughter and keep her until our court date? There is no orders in place at this time and she is living with a man who was arrested for sexual abuse of a child and multiple arrests for drug use. I have contaced CPS and the local police on this matter. I was told by CPS that i can keep her since there were no orders in place until court. What should I do at this point?
