Legal Question in Family Law in Texas
I have a 6 year old daughter with a man whom I was never married to. He has been confirmed to be her father by DNA testing. We have a verbal custody agreement stipulating that we each have her for one week, every other week, beginning on Sundays at 1800. My concern is this: She has repeatedly reported and shown signs of verbal and emotional abuse by her grandparents (whom the father resides with) as well as being taken by her father to a local bar where he became inebriated. I am uncomfortable with allowing her to return to his residence with her welfare being endangered. What should my next steps be?

Hire an attorney.
If you can get some proof that he is drinking and driving with the child, that would be very helpful. Perhaps a friend can go to the bar and watch how many drinks he consumes. Perhaps this friend will call the police if he then gets behind the wheel to drive with the child. A DUI would go a long way to show him being irresponsible.

If you do not have a court order, then you don't have to send her. There are no orders for you to violate.
