Legal Question in Family Law in Texas

I'm a 15 year old illegal immigrant, and I have lived in the United States since I was 3. I was wondering if my aunt who is a U.S. citizen could adopt me?

Yes, but your parents will have to have their rights terminated first. They can voluntarily relinquish their parental rights OR your aunt can sue to have their rights involuntarily terminated.

Adopting a child who does not have legal status is complicated and your aunt will need to hire an attorney who (a) practices family law and adoptions; and (b) is familiar with how to handle the special legal considerations raised by your immigration status.

Interestingly, if your parents have abandoned you here, you have a good chance of normalizing your immigration status and becoming a legal permanent resident (green card) and then a US citizen, with or without adoption.

Good luck!!
