Legal Question in Family Law in Texas

My 16 year old son has fathered a child with his girlfriend age 15 both live in Texas. Can he be made to pay child support while still a student in home school or will they make me his mother pay? Also, if he does pay child support, will he be allowed to have visiting rights to his child, he wants to have relationship with baby, but not girlfriend, so do I.

Sounds like you really need to talk to an experienced family law attorney.

I will charge him $1 per minute to talk to him. That 50% of my usual consultation rate. If he (or you) cannot afford $1 per minute then you are in really big trouble. You can come with him.

You need to hire an attorney as soon as possible in order to begin understanding what is about to happen.

He will pay child support based on minimum wage. Yes, he will need to get a job. If he won't work, then someone is going to have to pay his child support. If he's old enough to get a girl pregnant, then he's old enough to get a job. This baby needs to eat. As you know, this is never going to cover the actual cost of this baby.

Yes, he will be entitled to visit the baby. He will be entitled to short, frequent visits. He will not be entitled to overnight visits with a brand new baby. If her family hates him, it will not be easy.

He needs to have court ordered visitation with the baby.

Since everyone is underage, the parents will need to be involved since minor children cannot sign legal documents. Again, this is going to be a nightmare if her parents dislike him. This is the reason he needs court ordered visits so that they will be forced to allow him to see the baby.

He will be able to give the baby his last name since he is the father.

He needs to have DNA testing done when the baby is born to make sure he is the father.

Yes, he needs to have it done. Better now than finding out years later that he is NOT the father of this baby.
