Legal Question in Family Law in Texas
Hi I am 16 years old and my sister is trying to get custody of me.My mom had full custody of me but then she went to prison for 2 years.During this time i lived with my dad and now i cant take it any more.He verbally abuses me and on monday he woped me (not like put his hands on me,just woped me with a belt).Anyways i ran away and my sister is trying to get custody of me and thats the best thing for me because living wi8th my dad is not whats best for me.My moma wrote my sister signing over her custody to her but when she tried to unroll me from school they said the paper had to be signed by a judge.Anyways what should we do?Living with my dad is not the right enviorment for me.The best thing is for me to go with my sister.Me and my brother were in the same grade and he unrolled him and let him drop out he's not the person i need to stay with.

Your sister needs to hire a "family law" attorney.
She has the burden to show to the judge that the move would be in your "best interests". Your mom can voluntarily sign the paperwork from prison to give legal custody. I assume your father would object and it would be a litigated matter.
I recommend that your sister call Patricia Bushman at 713-807-9405 in Houston.
This could easily cost several thousand dollars if your father objects to the modification of custody. Your sister needs to be prepared to pay it.
If you need a mediator, your sister can call me.
