Legal Question in Family Law in Texas

I have a 2yr old who's biological father's name is not on the birth certificate. She does carry the same last name as him. She knows her father to be the man I have been with since she was 4mons old.

I recently married him and he would like to adopt her as his own. I am in Texas and her biological-father is in Kansas and she was born in Massachusetts. ( I know, it's complicated) How do I go about getting this started and which state do I begin the paper work?

The first question is: Does the biological father object if you terminate his parental rights? This makes a huge difference.

If he doesn't, then you file your case in the state where you live. Dad will sign an affidavit of relinquishment.

If the biological father DOES object, then the next question is: Do you live in Texas as a result of any action that HE took?
