Legal Question in Family Law in Texas
13yr Old Custody in Texas
I have a 13 yr old daughter that lives with the custodial mother. The daughter has lived with the mother for for entire life; however, she wants to come live with me. I am married with two other children and living in GA. The daughter will have a much better life here in GA. The household she lives in now is not stable, the mother has not worked in a few years. The mother cares for the daughter, but does provide the best atmosphere i.e. company, lifestyle, etc... I have a very stable household, good incomes and a good atmosphere to raise her. She would do much better here in GA. The mother does not want her to come here; I believe the main reason is the child support I pay her. She basically uses it to live off of, not for the intentions of providing solely for the daughter. Myself, my wife, and my daughter in TX all want her to live here in GA. What are the steps I need to take to get her legally here in GA? Do I need to hire a Texas attorney, or can I do anything from here in GA? She is of legal age to make her own decision and also thinks she would do better here.

You need a lawyer where the custodial parent lives.

Mr. Ashman is correct. You would need to file with the court a Petition to Modify Conservatorship. Know that she is not of legal age to make this decision; that doesn't happen until she is 18 years old. She is, however, old enough to advise the court of her preference, which would be a factor in the trial.
