Legal Question in Family Law in Texas

My 3 yr old

I am a mother of a 3yr old in Texas by another man other than my husband of 16 yrs. My husband and I are still together with my son's biological father listed on the birth certificate so that the bilogical father can have a relationship adn be held accountable for childsupport, but has my husband's last name. For three years its just been a mutual agreement between the bilogical father, my husband the step-father, and myself. Now that we want to join my husband in Germany since he is military, the military isn't allowing a command sponsorship due to my son being his step son even though he is the sole provider for him emotionally physically and medically. The bilogical father has visitation with his son whenever he wants him and it was agreed and has on a notarized paper of how much he pays me for child support of $325. What can I do such as showing a documentation for the mitary in order to get the command sponsership approved. The bilogical father is ok with us going to Germany with my husband for the three years that he is stationed there. Can we get by with just a notarized paperwork in with all party in agreement without having to go file in court?
