Legal Question in Family Law in Texas

Hi, I have a 9yr old son that was abused by his biological father when he was 2yrs old. He (my son) had to be takin to the hospital for bruises all over his body and bite marks that his biological father did to him. I myself was also abused by his father at the same time he abused our son.He did serve half of his sentence in jail and came out. But 7yrs ago i met a wonderful man that came into my son's life that cared for him and loved him like a father should ..My question to you is how can i go about changing my son's last name to my husbands last name?? This Is my first attempt on trying to do it and the lawyers that i have spoken to are very pricey... I also thInk to my sons biological father is incarserated agin.. So If you can please help and give me direction on how to start this process .. I also have hospital documents of how my son looked at the time when he got abused and court papers showing that im the managing parent.. and the biological father is to stay away from us and there are court records that dont have are names or any information of where me and my son are. Thats how the judge wanted it so he wont look for us or harrass us... please help cause my husband is trying to adopt him thanks alot
