Legal Question in Family Law in Texas

Hi, I have a 9yr old son that was abused by his biological father when he was 2yrs old. He (my son) had to be takin to the hospital for bruises all over his body and bite marks that his biological father did to him. I myself was also abused by his father at the same time he abused our son.He did serve half of his sentence in jail and came out. But 7yrs ago i met a wonderful man that came into my son's life that cared for him and loved him like a father should ..My question to you is how can i go about changing my son's last name to my husbands last name?? This Is my first attempt on trying to do it and the lawyers that i have spoken to are very pricey... I also thInk to my sons biological father is incarserated agin.. So If you can please help and give me direction on how to start this process thanks alot

It's good that you have spoken with attorneys, because this needs to be handled by an attorney. Keep looking for someone that is experienced, but that you can afford. You have two options. You can petition for a minor name change, and notice the biological father of the petition and hearing date. You could also petition to terminate his rights, and your new husband can petition for a stepparent adoption.
