my 16 yr old son lives with his dad who has custody. he wants to come live with me. what does he have to prove as there are no differences in houses, he just wants to be with me.

He can advise the court of his preferences, and explain why he prefers to spend time with you. Often a modification of conservatorship is not about the 'unfitness' of a parent. If the court agrees that it is in his best interest, and satisifies the statutory requirements, he/she may modify primary conservatorship.
