Paternal Grandmother desiring legal custody of grandson, father deceased, mother left child with common law stepfather over 2 months ago, no phone calls yet. Child born in Texas, picked up from stepfather in Ohio.

If you have possession of the child in TX, you can file a Suit Affecting Parent Child Relationship. If the whereabouts of the mother are unknown, she can be served by publication. I advise you to get an attorney to be sure of getting your custody.
