Access to Child

My friend is going through a divorce. The soon-to-be ex-wife is failing to cooperate with visitation until court orders are in place. She has sent a Cease and Desist letter saying that if my friend continues to contact her about visiting his son, she will file harassment charges, change phone numbers and not give him the numbers to their home or cell. Is this legal and how should he respond to the C&D letter? Also, can my friend visit his son at his school since the mother will not allow him access after school hours?

Your friend needs an attorney.

I highly recommend Patricia Bushman who also advertising on this website. Pl. tell her that FRAN sent you to her.

Visits at school are up to the individual school.

The cease and desist letter is just a threat. However, he needs temp. orders NOW. He should be able to visit the child. Obviously, he needs a judge to order her to allow it.
