Legal Question in Family Law in Texas
I am active-duty military, stationed in Virgina, but my state of legal residence is Texas. Am I still able to file for divorce in Texas as a resident?
I hold a Texas driver's license but I have not resided in Texas since 2009. I have no property in the state but still carry Texas as my state of residence.
Please advise on my options

If Texas is your legal residence in the military than you can file here.
But if your wife does not live in Texas, you can also file where she lives.
If she never lived in Texas then the divorce can be granted but the divorce court would have limited jurisdiction over her.
You probably need to talk to an experienced family law attorney.
I cannot tell what county you claim in Texas. Look on this website and on www.avvo.com for an attorney in your county to consult with regarding where to file for divorce.
If there is real estate involved then I usually recommend filing where the real estate is located since you will probably need to do paperwork regarding the real estate. You want an attorney that understands state law regarding that state.
