Adjudicating Parentage

Baby born out of wedlock and father is wanting the babies last name to be his,but the mother put her last name on the baby.So does the father have an legal right to make her put his name as babies last name? Also what other rights does the father have since he does not pay child support? Thank You

This father needs to pay child support, then he can start talking about rights. He would have a right of visitation and all those accompanying rights.

If there has been no court to declare him to be the legal father of this child, then the man has no more rights to the child as any stranger.

I recommend that DNA testing (a mouth swab) be requested before the court declares him to be the father of the child.
