Want to adopt a related 7 yr old without parental consent

Hi. Little girl is my wife's great-niece. Parents haven't been together almost her entire life, but they've never legally divorced. She was given to us by the mother when she was 1 to adopt, because the mother couldn't handle her (too young). She was taken back 4 months later.

Now, the little girl is still more attached to us than her mother and remains a nuisance often to her mother who doesn't even have a car and keeps losing jobs. We now have reports of abuse, by the father no less.

Would we have any legal ground to try and get the courts to give us the little girl?

Her name is Brianna.

You really need to go talk to a good family law attorney in your area. You might have grounds, but only an experienced attorney can tell you for sure. Good luck.

In all honesty, you are putting the cart before the horse. Just because the child doesn't have the best of home environments is not necessarily a good reason to terminate parental rights. I suggest you try for custody first. That will be tough enough. but you might have a chance of winning. Gonna cost you some money. Merely because your cause is just in your heart doesn't mean that you won't have to pay the price to obtain justice in the legal system. Talk to family law attorneys in your area. Get in an idea of what is required and how much it will cost. Good Luck.
