Adoption

I would like to adopt my 4 year old step son. His father has full custody of him since the child's mother hasnt paid any child support or even seen her child since he was 1. Do I still have to ask consent from the birth mother? How do I go about with the adoption?

The child's father will need to file a suit seeking termination of the mother's parental rights. Simultaneously, you and the father will file a petition for adoption.

The mother will be notified, and she will either agree to it, or contest it.

This is a fairly complex proceeding, and not something you can accomplish without an attorney.
