adoption of a baby i already have custody of

Me and my husband are going to adopt a baby girl that we already have custody of. She was taken from the birth mother at birth because she was born with cocaine in her system. The mother has already reliquished her rights. She is in federal prison. The bio dad is also in fed prison and will relinquish his rights as long as we agree to let him have visits with her when he get out of prison 2 times a year. If I agree to it and it is being put into writing will I have to let him? Do you think the judge will terminate his rights either way. CPS is involved and are pushing for his rights to be terminated. He was not married to the mother and his sentence is 4 years in federal prison.

Are you doing this without an attorney? You need to have a lawyer. If you already do, this is a question best posed to your attorney. If you don't, please get one right away. If this matter is not handled correctly, you could have chaos down the road.
