Legal Question in Family Law in Texas

My husband is wanting to adopt my 3 1/2 year old son. The father has no contact with him. There has never been a paternity test done. He has only seen him 1 time in 3 1/2 years. Do I have to inform him of this? No listed father is on my son's birth certificate.

Re: adoption

The natural father of your child must be informed and his parental rights terminated. No judge anywhere would let the adoption occur if (s)he knew that the father was not notified. Just because there is no father listed on the birth certificate, doesn't mean there was no father. That has only happened once. Even if you don't know where he is, he still has to receive sufficient legal notice. If you can't find him, you must pay for an attorney to represent him. Good Luck.
