Adoption

My husband wishes to adopt my severely handicapped daughter - age 15 - who is not cared for or provided for by her biological father (who is court ordered to pay child support) and my 17 1/2 year old wishes to disown him and have her step father adopt her. My ex is a chronic drug user and cannot keep a job and lives with his parents. How do I proceed with this type of action to force him to release the children who he does not want nor cares for but refuses to do so.

If the child is almost 18, you should wait until she turns 18 and do an adult adoption.

It's much easier and less expensive.

An adoption takes several months so it might be worth the wait.

You can do the adoption and termination of parental rights at the same time. You might want to go ahead and get a judgment for the child support arrears. Never can tell he might win the lottery or something.
