Adoption by stepfather

I have a 12-yr old son. His father (we were not married)

has not seen him nor been in

contact since he was 9 mos. Old. What has to be done for

my husband to adopt him?

You can do the termination and adoption in the same proceeding, but in order to do it correctly, contact an attorney.

First, you would need to have the biological father's rights terminated. Once his rights are terminated, your husband would be free to adopt your son.

You should sit down with a family law attorney to discuss the process in detail.
