Legal Question in Family Law in Texas

Adultery and custody

I was wondering if I cheated on my husband 2 years ago and I have been the soul bread winner for all of our marriage. I own my own home, car, everything. My husband owns nothing, can he get custody just because I cheated, even though I have no other record of getting into any kind of trouble?

Re: Adultery and custody

Adultery is an issue of division of property in a divorce.

Adultery is not usually an issue in a divorce. Especially since it was 2 years ago and he stayed with you. Adultery does NOT mean that you are not a fit parent.

You really need to talk to an attorney in your area.

You might want to read the Houston Bar Association's pamphlet available on line. I think their website is www.hba.org - then look under "for the public" and check out their booklets on line -- you want Family Law.

Merry Christmas!
