Adultery

My question is ... can someone be arrested for adultery when the couple has been separated for 3 months and what are the chances of actual arrest.... and does the law change for couples with a spouse in the military?

I have not known anyone to get arrested for adultery in Houston, Texas. I'm sure it's happended -- but the police in Houston have better things to do than go around to motels arresting people for sleeping with a non-spouse.

Adultery usually comes into play in divorces. It can be used as ground for divorce and can be used for one spouse to get a disproportionate share of the community estate. (I'm sure that I've totally confused you by now!)

You did not ask but -- I don't know of anyone that has been arrested by bigamy in Texas!

However, I do know of a woman that was arrested for statutory rape of a 15 year old boy in Texas.

As for military, the military has their own code of conduct. If you violate their rules, you will face the consequences with them.
