Legal Question in Family Law in Texas
Is Adultery enough to stop a parent from having visitation with children?
My friend is in the process of moving out of the home with his wife. He had a affair, and his wife is threatening that if he leaves, she will not allow him to have visitation with his daughter. He is miserable, but does not want to lose his daughter forever.
Can she do this?

Courts generally encourage visitation between the parent and child. They will also upon request often issue orders preventing parents from dating others in front of the child during the divorce. Of course, if the object of his affection is not of the opposite sex, or if there are other similar issues, the Courts take all manner of things into account when determining the best interest of the child, including denial of the child's right to see his or her parent.
