Legal Question in Family Law in Texas

Appreciate the advice from a legal expert. My daughter attends daycare, however is not enrolled in a primary or secondary school, therefore my ex-spouse and I follow the schedule of the public school district which is DPISD. The DPISD calendar shows the Thanksgiving break is November 19-23 (Mon-Fri). I�m trying to determine if I will have possession of my daughter that third weekend before the break begins as I�m unable to make out the day in which kids in the public schools are actually �dismissed from school� as stated in the language of our Modified Possession Order for Holidays. Further, I have provided my possession period below.

�Thanksgiving in Odd-Numbered Years- In odd-numbered years, SARAH ELIZABETH YANCEY shall have the right to possession of the child beginning at 6:oo p.m. on the day the child is dismissed from school for the Thanksgiving holiday and ending at 6:oo p.m. on the Sunday following Thanksgiving.�

My possession is as follows:

1. During the regular school term from Thursday after school until return to school on Monday on the Thursdays preceding the first, third and fifth weekends.

2. During the regular school term from Wednesday after school until return to school on Friday on the Wednesdays preceding the second and fourth weekends.

First, let me caution you against posting details such as language from your order, and your name on a public website such as this.

Find out the date that children are dismissed from school, and your Thanksgiving possession begins that day at 6 pm. There should be language at the beginning of your holiday schedule that says it supercedes all other periods of possession in the order. This means that sometimes, holidays will cause a parent to gain additional time, and sometimes lose time. It is anticipated that it will even out over the long haul.
