What age is it that when a child of a divorce couple doesnt what to see the non coustodial parent. i am 12 and my mother is verbal abuse to me when i am there and my stepfater is worse. i really dont want to go there any more, i have talked to my dad and we just dont know what to do please help

I believe you are thinking about the age when a court will listen to the child's desires in determining managing and possesory conservatorship of the child. That age is 12. However since mom is the non custodial parent is appears that you already have what you could get by talking to the judge.

The problem is that your mother has a right to see you as long as she is your mother. Your dad could file a motion to modify the custody provisions to further limit mom's visitation or so that her visitation was supervised. This measure is expensive and is not guaranteed to work. Further, things could end up worse. The court could make your mom the managing conservator and your dad the possessory conservator.

Your dad needs to consult a local family law attorney to discuss his options and determine if it is advisable to do anything.
