age of consent laws

My girlfriend is 17 and I am 25 and we live in the state of Texas. I am aware that the age of consent in Texas is 17. I keep reading this ''affirmitive defense'' about being 3 years apart. Is that 3 years apart if you are below the age of consent or does that apply even when one of the parties involved is 17? Need some Clarification

The affirmative defense applies when one person is younger than 17.
