Legal Question in Family Law in Texas

my ex does not agree to pay 1436 mnth for child support he is in the military and in training he get's BAH of 1436 - he tells me that he would like to not inlcude BAH b/c he won't be getting that much once he is done. He tells me he is going to file a contigency therefore the boys will not get more until we have a bew court date 6 months from now. Questions is can I ask for re-cup of what they would be getting if he agreed to 1436 or will it just be lost?

Military pay varies all the time. It never seems to stay the same. ALL SOURCES OF INCOME ARE COUNTED FOR C.S. If his income varies, the court will average it.

Is your ex ordered by a court to pay $1436 a month? If so, he has to pay it UNTIL a court modifies the order.
