Legal Question in Family Law in Texas

alchohol consumption by a minor

My 17 year old daughter received a ticket for alcohol consumption by a minor. Is it true that even if she received deferred adjudication it will remain on her record as a conviction? If that is the case, should I hire an attorney? This is the only offense she has ever had. I am divorced and am the legal guardian of the children, but my ex-husband had her for the weekend at the time according to our joint custody agreement.

Deferred adjudication is what it says. The court does not accept a plea of guilty and places a defendant on probation and postpones a final decision on the case. If the defendant complies with the court ordered conditions for probation the case is dismissed. There is no conviction, but it does require the defendant to plead guilty (acceptance of the plea is deferred).
