Alienation of Affection

TX does not allow Alienation of Affection lawsuits but what can someone do when another women becomes involved before a divorce is final. We were seperated for 6 mths before he met her but he had not filed for the divorce nor had it even been mentioned until she entered the picture. I have emails from her to him saying she wants him to be free to be with her. Can I sue her for pain and suffering?

Anyone with a filing fee can sue. The question is, can you win? Your marriage was already on the rocks long before she came into the picture. I'm just not sure you can convince a Judge or jury that she is the villainess you think she is and deserves to be punished.
