Legal Question in Family Law in Texas

Alienation of affection/adultery... can I be sued?

What is Texas' law on alienation of affection and/or adultery? Is their any Federal law? I'm the outside party to an adulterous relationship; a divorce is now pending. I've been threatened with legal action and want to understand the libalities and what I need to do to protect myself. Thank you.

Texas has no cause of action for alienation of affection and adultery is not a criminal act in Texas. If you accept gifts from the earnings of one spouse or other community property source, then you may be sued for a conspiracy to defraud the complaining spouse of that spouse's community property rights.

To add to the other attorney's answer.

You can be subpoened into court and have to testify.

If you do not tell the truth or refuse to testify, you can be held in contempt of court by the Judge.

You will not be compensated for any time you miss from work. You might be required to come to court more than once -- this will depend on the Judge's trial schedule.

Good luck!
