Legal Question in Family Law in Texas
alimony in the state of texas
I have been told that there is alimony in the state of Texas. I need to know if the alimony (if legalized in Texas) would be awarded to the cheater (husband) who carried on a relationship while married with another married woman.I am asking for my sister. She was married for 16 years and has recently found out about the other relationship between her best friend and her husband. He is currently living with the girlfriend and the divorce is not final.

Adultery does not determine if someone gets alimony in Texas.
I liked Paul Hebda's answer so please be sure to read his comments.
Please be advised that the Advanced Family law seminar is being held in San Antonio, Texas next week so many family lawyers will be unavailable from August 6-10th.

Under certain situations, a limited period of alimony is available in Texas. Your sister has been married over ten years, the first prerequisite to obtain a grant of alimony. You did not state anything about her work history, prospects for employment, or if any spousal abuse took place. All other things the court and the law considers for a request for alimony.
She definitely should be speaking to her attorney about her situation and whether or not she qualifies under Texas law.
