Legal Question in Family Law in Texas

Ammended Child Support and Medical Support

In May of 2003 I requested the Attorney General review my x-husband's income and also requested he cover our child on insurance.(past 4 years I carried ins.)The AG found my x made alot more money and increased the cs by 50%. They also ordered him to start carrying the insurance. My question is, my x is refusing to fill our childs medication while the child is in his care. He said, 'I cover the insurance, you have to cover the co-pays' This is a medical necessity for the child. Is he correct? Do I pay even when our child is in his care?(not weekend visit but a week or more)He is also, refusing my phone calls, emails and now my certified letters. What do I do?

Re: Ammended Child Support and Medical Support

In a standard situation the non primary parent pays medical insurance expenses in addition to child support. All copays are a 50/50 split and non prescribed medicine is just paid for by the parent they are with at the time. All of this should have been recorded in the order that raised child support and ordered that he pay health insurance. If the AG failed to put it in, ask for a clarifying order.
