Amount of arrears for criminal non-support?

How high do arrears have to be on a child support case to be considered for criminal non-support?? The NCP has not made voluntary payments in 26 months. Is it the amount of time he hasn't paid that matters or is it the amount of the arrears???

He qualifies. Contact the child support division of your local district attorney's office, or the same division of Child and Family services.

These government agencies have ways of getting child support which do not involve sending someone to jail, and that is usually better for you because in jail he cannot make support payments.

In Texas, before the Sheriff's office will arrest someone for criminal arrears, an arrest warrant must be issued. The AG usually pursues intermim steps before a warrant is issued. If your situation allows assistance from the AG's office, you should contact them. They usually work on cases involving welfare mothers first, but they might find time to work on your case if it appears that they could have quick success. If not, some private attorneys accept such cases on a contingent basis. Naturally, they would want payment out of whatever funds they collect.
