Amount of Child Support Allowed
I am recently going through a divorce. We had previously agreed to $400 every two weeks and him mantain medical/dental until it was final. I have to fight him right now everytime it is due. I am wanting to request the maximun now and have it garnished from his wages. The hearing is set for the 12th of September and he has already signed the degree (never read it though). Niether of us have attorney's at this time. I filed on the 12th of July. I have been very nice and tired of having to fight for the money. So, I would like to get the max. now. Without commissions he makes about 35,000 a year and we have two children ages 9 and 10. What do I do? THANKS!!!!!

You may be doing what you should be, but I am not sure

what your hearing is for. If it is to get the support

taken from his paycheck, that should happen. I do not

know about increasing the amount, especially if the

decree was just signed. But I guess it doesn't hurt

to try. The statutory guidelines for 2 kids at $2916/mo

(not counting any offset for his paying the health ins.)

is approx. $590/mo, so you appear to be doing well

already.
