annulment of custody agreement

My ex and I want to change our custody agreement to say that we have equal rights and visitation. My ex filed a motion to dismiss judgment and a motion to transfer venue from the county of my permanent residence to the county of our current residence, but both motions were denied. My ex did not hire an attorney for any of this and made some mistakes in filing that my attorney said prevented her from being able to let the motions pass.

How can we get our current custody agreement off the books and arrange a new agreement together in Hays county?

You indicated you have an attorney. Talk to her. I'm sure she knows how to transfer a case to a different county and modify a custody agreement.
