Legal Question in Family Law in Texas
answer to divorce citation
My husband,85 fled for divorce in Texas. I live in Canada for over 2 years. The Texas court ordered that service on me be effected by my son. I did not acept it and signednothing.
Do I have to file a written answer, or ay I ignore it?
Nt answering it, may the court take default judgement against me?
What may that judgement be on a 83 years old woman Jail? Money? Both?
If I answer, may I tell in details why I left my husband over 2 years ago? (He is a compulsive gambler with huge credit card debts.)
Please advise as son as you can.

I realize you are not in the country, but you really need to talk to a good Texas Family Law Attorney. See if you can find one in the county in which the divorce was filed who will speak with you over the telephone. I don't know when you were served through your son but the clock is ticking. You only have about 20 days between service and when your husband can try to get a default divorce and take everything you both own. If you wait too long it won't matter why you left or what is fair. All that will matter is you didn't file an Answer. Good luck!
