Legal Question in Family Law in Texas

How to answer Original Petition in a suit affecting Parent Child Relationship

I was named in a suit Reguarding the welfare of a minor child. All of the accusations are untrue. I want to clear my name. Do I need an offical Respondent Form, or do I just send a formal letter to all parties involved.

I am not the childs father, nor am I named on the Birth Certificate. The grandparents are seeking full guardianship, and I hope they get it. However, I am described as an unfit father, but they also claim I am not the father too. I am separated from the childs mother.

I am a little at a loss to know why you were served with this Petition, unless you are considered the putative father of the child.

There could be consequences to you, including child support. My advice would be to retain an attorney to file an answer. This is a legal pleading, that if not done correctly, could expose you to liability.

I would then have my attorney contact the grandparents attorney and offer to get a DNA test at their expense. If you are not the father, then it makes their lawsuit much simpler.

You will want to file an Answer. You want to be involved in this case. Otherwise, if the court finds you to be the father, you will be ordered to pay child support on this child.

If the case is in Ft. Bend or Harris County, contact me.

I can't give you my phone number on this website.

I'm 3 days behind in returning free consultation phone calls.
