Legal Question in Family Law in Texas

Anullment or divorce in case of bigomy?

I am currently married to a man who was previously married to a woman in Louisiana. Come to find out he never was divorced from his former wife. My ''husband'' and I are currently separated and I was wondering if I will need to get a divorce or if an anullment is an option. His wife in Louisiana is filing legal action against him for bigomy. If he was still married, does that mean we were never legally married? I hope to remarry some day and would hate to end up a bigomist myself because I didn't do the what is legally required in this situation. Any advice is appreciated.

One of the grounds for annulment is fraud in inducing you to enter into the marriage. If you have cohabited with the other person since learning of the fraud, then annulment is not available to you. You should run this by an attorney in any event because there will be property rights to unravel between you no matter what your marital status is, and in any event, you need to get that status clarified by either by annulment or divorce.
