Legal Question in Family Law in Texas

We have an AOP in place. The military does not acknowledge this but the father is voluntarily claiming paternity and signed the AOP. He is listed on the birth certificate and my son has his last name. I am not seeking formal child support we have an agreement what I need to know is what will be acceptable to file with the military to enroll our son on insurance. He is also going to go and live with his father, he is 13 now. Do we need to do an adoption or what? If he is listed as the father voluntarily and is going to have parental control over him what do we need to do to make this legal i guess.

You file a Suit Affecting Parent-Child Relationship, together with an Agreed Order that establishes paternity, child support, conservatorship, etc. The military will require a court order, since you were not married at the time of the birth. You will need an attorney, but if all the agreements are in place, it should not be unduly costly. Good luck.
