appeal final divorce hearing from distict court
I was in court 1-2-02. for a final divorce hearing. my ex-wife had an attorney but I couldn't afford one. The court set my child support for my two daughters @ $1,250.00 a month. I work at a convience store making $6.75 a hour. I can't make that much unless I work lots of overtime. The last two weeks i worked 91 hours each week, that's 182 hours in two weeks, but I don't think I can keep up that pace for 5 more years when me kids turn 18. I need to appeal this divorce. In was finalized in district in comal county, texas. She also got to keep all possesions, all i got was the clothes on my back.

Your child support doesnt sound like it is within guidelines set forth in the Texas Family Code, which would set your child support at 25% of net available resources. You can file a motion for new trial but must do so within 30 days of the last hearing. If you are going to appeal you must also file a notice of appeal or lose your right to appeal. Start with the Motion for new trial and if that fails then appeal. You may be able to qualify for free legal representation. Contact your local bar association for a referral to a free legal clinic.
