Divorce was in Tex. and I moved to MIch.The Tex. court order was for 300.00 a mnt.and I got 13,000.oo in arrears.I was ordered by Mich. to pay the same,with x amount to keep me current and x went to arrears,which came to same amount.This was in 91.Six months ago Mich. said I owe 2000.00 so I wanted to pay it off.Tex. says no.They say,I still owe the 13,ooo.oo plus intrest so they say now I owe about 20 or 30,ooo.oo.So they are still garnishing my check.I sent copies of all payments,and the Mich. order,to no avail.Mich. says I met my obligations Tex. says no. What do I do now?Do I get a Mich. attorney or a Tex.one.Or,do I keep paying till I die, I am 51,and probably will not see the day its paid off.Please Help.

I handled a case very similar to this a few months ago. Although all of the facts aren't there to know exactly what is happening, I assume that the reason that the arrearage is not paid off is that you are just paying the interest and not making much, if any, headway on the principle amount. I represented the mother in that case and we settled with the father paying a significant amount of the arrearage even though he had already paid over the entire amount of the original arrearage.
Since then, however, a new case has come out that MIGHT have provided him some relief in this situation. You need to retain a TEXAS attorney, give him or her ALL of the facts and documents and get the case analyzed for its specific circumstances. Paying just enough to cover the MANDATORY interest can be disasterous for the payor and an agreement has to be reached or the arrearage paid or else you may actually be paying for a long time.
