Legal Question in Family Law in Texas

My ex being arrested

Today I found out that my ex husband, whom has our two boys (shared custody) was arrested. I called the sherrifs department and found out that it is four felony counts of prescription fraud. I am at a loss of what to do about our kids. Do I need a lawyer? He he possible doing jail time? Or because it is his first arrest is he doing parole time? I am wondering where I stand in all of this and what advice you can give me.

Go pick up your kids, if you haven't already. Then call your lawyer. At least temporarily, until it is determined if there is any truth to the allegations, your kids need to stay with you. Call your lawyer to see if you need to modify your decree. You exhusband may or may not be cooperative. His criminal problems are his to deal with. -- you need to consult a lawyer about the custody arrangement.

You can file a Motion to Modify to suspend his visitation. Until a judge signs an order suspending his visitation, you are still required to turn over the children during his period of visitation. Don't just withhold the children as you may be inviting a motion to enforce.

Get your own family law attorney to assist you with the children and any support issues. Leave the criminal stuff for your ex to deal with. Good job leaving that loser!
