Legal Question in Family Law in Texas
ok so i asked a question last week about a paper that i signed concerning my son being placed with my boyfriends cousin. Well this week we talk to the best attorney in our county and he told my boyfriend and i that we need to go to at least 2 parenting classes and then make an appointment for my son with a pediatrician and have the pediatrician to record that everything is fine with my son but to take him to that appointment we are risking my son being put in a foster home until cps takes us to court which will take up to 10 days to do and i do not want my son with a bunch of strangers. I was wondering what is the best way to get my son without cps causing any problems. our attorney told us to just get him becuase our case is BS and CPS had no right to take our son and that all they can do is take us to court. Ive heard a lot of crap about foster homes and even in this year in the state of Texas there were more than 1 deaths of children in foster homes. my nephew was in a foster home for 4 months and came back scared to death of everything and was only 6 months old when he came back home and was putting his gas mask thing on himself that is crazy stuff! i dont want my son to be with strange people not even if its for 10 days or less. he is already in danger living with my boyfriends cousin she leaves him in her car for 5-10 minutes everyday with the car running in the bad side of time where i wont even go myself. she slaps his hand he is only 8 months old! I just need to know what other option do i have to getting my son without them putting my son in a foster home for 10 or less days. We plan on asking our attorney but i would like to see other suggestions also. the way i see it is wouldnt cps look at the fact that my boyfriend and i are taking these classes and making him appointments to check his weight and make sure that he is ok.

You met with an attorney in your county that you said is the best.
I don't recommend that you "shop" answers. Each county is different. In fact, if I find out that a client is "shopping around" I withdraw from the case. I don't need clients that don't trust me. One of the things that an attorney offers in his/her legal opinion and advice.
My personal opinion is that CPS can do anything they want at any time they want. They scare me.
