Assault charges when it was self defense
My sister is in the middle of a custody dispute and the father of their child filed an assault charge on her. The charge is from when my sister, my other sister, and I were taking my nephew from him and my other sister (not the mom) started punching the father to let go. Now we have considered this self defense since the father is not capable of handling the child since he is on antidepressants and has threatened to kill himself. What I am asking is, how does she get out of this situation other than giving her statement along with the other sister?

Based on what you have written, it would appear that no statements should be made without consulting a law firm. Additionally, are the assualt charges criminal (being brought by the District Attorney) or civil (being brought by the father)? My advice is that everyone needs to stop making statements, and hire a lawyer. Statements made without the advice and consent of the attorney are often regretted later.
