Legal Question in Family Law in Texas

is attempting to cheat grounds for divorce?

is attempted cheating a grounds for divorce? I have obtained proof that my husband has attempted to cheat on me with someone. (they admitted it to me, and I have emails stating he was setting up liasons). While my husband did not meet with this person(s) to carry out an affair, he has been actively seeking to have sex with someone, but meetings never took place. This is not the first time he has done this. Can I file for a divorce because he has attempted to cheat and not carried it out, or does that fall under ''irretreivable breakdown of the marriage?'' I just found this out today, I'm very upset. Thank you

Attempting to commit adultery, is not adultery. It is however, a cause for the breakup of the marriage, and fault can be considered cruelty. Fault can be a factor in the division of the community estate. He has established a pattern of behavior. You should be meeting with a lawyer tomorrow, at least to prepare yourself for the future.
