Attended a review case & wasn't aware he had to bring any paperwork. So it was decided that I made $1200 a month and the new child support amount was based on that when in fact I hadn't worked in over a year but instead recieve a small amount of disability because I am in stage 4 emphysema. I was advised by the district attorney after to file a modification with them. I did. Instead of changing the amount accordingly they just put a hold on my disability. My guess now is that I need a court hearing to correct these mistakes... is that correct? I also heard somewhere I should file for Motion to Withdraw the Administrative Writ. Is that correct? Is that what I should file to have the amount of child support due each month changed according to the amount of disibility I get? Because right now they are basically taking all of it. You can try going back through the AG process, but it is not an efficient system. You will probably need to get a court to review your earnings/disability and modify your child support.
